At point c, item 1, article 13 Ordinance on immigration, migration, residence of foreigners in Vietnam dated 28th April 2000, foreigners who are temporarily residing in Vietnam in one of following cases are considered and approved of permanent residence:

Wife, husband, child, father, mother of Vietnamese citizen permanently residing in Vietnam

Permanent Residence Card has unlimited validity, every 3 years, the card holder will have to update their Permanent Residence card. The card holder also can use this card as an unlimited visa to come to Vietnam.

Apply for new permanent residence card:

Required documents:

  1. 02 application forms for permanent residence (Form N7, attached with 04 passport photos 3 cm x 4cm).
  2. 02 curriculum vitae statements of the applicant (Form N10)
  3. 02 judicial record copies approved by competent public authority of the country where such person is a citizen or of the country where such person permanently resides.
  4. Diplomatic note of competent public authority of the country where such person is a citizen requesting for approval of such person’s permanent residence in Vietnam (Attached with a transfer note of Vietnamese diplomatic agency).
  5. 02 copies of passport.
  6. 02 copies of Vietnam visa or temporary alien card valid at the time of submitting documents, 02 copies of immigration declaration.
  7. 02 copies of documents to prove being wife, husband, child, father, mother of Vietnamese citizen permanently residing in Vietnam.
  8. 02 guarantee letters for foreigners temporarily residing in Vietnam (Form N9) confirmed by People’s Committee of ward, commune, attached with 02 copies of Identity card, family record of the guarantor. The guarantor and the guarantee must show documents to prove having legal houses or legal financial sources to ensure having house and life for the guarantee.

Above documents (except for application for permanent residence, diplomatic note, passport, visa) must be translated into Vietnamese and certified or legalized as regulated.

Where to apply for Permanent Residence card: The Immigration Department of the city where the foreigner lives.

Returning result: Within 6 months, Immigration Department must consider and confirm whether they accept to issue the Permanent Residence card or any changes/ additional documents required. After confirmation, the Immigration Department will have to issue the Permanent Residence card within 5 working days.

Renew, change, update permanent residence card:

Every 03 years, Permanent Residence Card holder must bring their card to present at Immigration Department of the province, city directly under the Central Government, when presenting he/she must show permanent Residence card and submit photos to change for new card.

In case he/she wishes to change the contents of the permanent residence card, the residence card holder must submit the application to Immigration Department of the resident place. The procedures are as follows:

  1. 01 statement request for changing permanent residence card (Form N8, attached to 02 3×4cm photos) confirmed by local public security of the residence place.
  2. 01 copy of passport (bring original to compare)
  3. 01 original old permanent residence card.

Period of returning result: 05 business days since the date Immigration Department received valid documents.

Note: In case of reissue due to loss, the procedures are the same as change Permanent Residence card and submission of 01 statement of the reason for loss.

Period of returning results is within 14 business days.

Diplomatic visa exemption accord signed with El Salvador

An agreement on visa exemptions for diplomatic and official passport holders from Viet Nam and El Salvador was signed in Ha Noi yesterday after successful talks between the foreign ministers of the two countries.

During the talks, Pham Gia Khiem, who doubles as Deputy Prime Minister, and his El Salvador guest Hugo Martinez Bonilla agreed that the two countries should further tap their potential in consumer goods production, agriculture, science and technology, culture, healthcare, education and training, and telecommunications to scale up currently modest economic relations.

The two also agreed on mutual assistance to expand El Salvador’s relations with other countries in Southeast Asia and the same for Viet Nam in Central America.

Khiem and Bonilla pointed out the need to speed up negotiations and sign a number of co-operation accords soon in order to lay the foundation for a legal framework on bilateral relations, especially in economics, trade and investment.

They said measures should be taken to encourage and create favourable conditions for businesses from both sides to take a foothold in each other’s markets and establish direct partnerships.

Host and guest shared a view on promoting the exchange of delegations at all levels to deepen political relations, increase mutual understanding and work out measures for co-operative efficiency.

They also agreed that the two countries should continue with close co-ordination of action and mutual assistance in international organisations and multilateral forums such as the United Nations, the World Trade Organisation and the Forum of East Asia and Latin America Co-operation (FEALAC).

The two foreign ministers highlighted close relations, particularly with Bonilla inviting Khiem to visit El Salvador, which he accepted with pleasure.

In addition to the visa exemption agreement, the talks concluded with the signing of a memorandum of understanding on establishing a reference mechanism between the two foreign ministries.

Vietnam work permit for expats

As many expats in Vietnam have experienced, the Government recently became firmer with the applications and extensions of business visas. In fact, foreigners in Vietnam have been required to a have a work permit and a business visa for quite some time, but before it has not been enforced and most expats in Vietnam have been using business visas only. It seems like the reason to the sudden change is a problem with illegal Chinese workers in Vietnam.

The best solution to the problem is to get a Vietnamese work permit, and luckily the rules for how to obtain a work permit has become a bit easier. Earlier you needed a university degree AND 5 years experience within your current field. As of now, you only need to have either University degree OR 5 years experience working within your field. For some fields you can also use a professional skills certificate, ex. accountant certificate.

So what do you need to get the work permit?

In order to get a work permit, an expat in Vietnam need to have 3 things:

1. Work contract.

2. Support to from your employer to get the work permit.

3. University degree, higher degree, professional skills certificate OR 5- year experiences working in the same major.

Paper work required to apply work permit

From employee:

1. Work permit application form (following a provided template)

2. Work permission application letter (following a provided template)

3. Criminal record: If you have stayed in Vietnam for more than 6 months, you will have to get the criminal record that is issued by the Judiciary Department of the city where you are living. In case you are not in Vietnam or you have stayed here for less than 6 months, you will have to get that criminal record from your Authority Government.

4. A copy of your certificate or degree. This can be: university degree, higher degree or a special professional skills certificate ex. accountant certificate.

In case you do not have a degree, but you have 5 years experience working within the same field, you will need to get a confirmation letter from your old employers or any paper work to prove that you have 5 years experiences within your field in Vietnam or another country. This paper work will then be translated into Vietnamese and certified by a Vietnamese Government agency to prove that this translated version has the same meaning as the original one and can be used legally in Vietnam.

5. Health check from the hospital. There is a list of hospitals that has the authority to give you a health check in Vietnam and only the hospitals on this list are qualified to prove your health for the work permit application. You will get this list with the first 2 templates for paper work; the Work permit application form and Work permission application form. In case, you are not in Vietnam, you can get a health check from any hospital in the country that you are staying. This health check is valid for 6 months.

7. 3 new passport photos.

From employer:

1. A valid labor contract.

2. The company license (copy certified by Government authority office)

3. Work permit application form

4. The approval from the Government to use foreign labor.

The 5 years of experience can be counted as total amount of years you have been working in your field. For example:

Mr.A does not have any degree. He started working in Japan from 2001 to 2004 as a web designer, in 2004, he left and traveled around the world. In 2005, he worked at General Manager’s assistant at a real estate company in America, he worked here until 2006. In 2007, he left this job and went to Thailand. He worked at a web agency as a web designer. He left this job in 2009 and come to Vietnam, here he wants to work for another web agency as web designer and he needs a work permit. So Mr.A will need to get confirmation that he used to work as web designer from the company in Japan (3 years experience) and the company in Thailand (2 years experience).

Any paper work that is not in Vietnamese, need to get translated by a Vietnamese Translation office and get stamped to certify the validity of the document. Any paper work that is in Vietnamese or not in Vietnamese, if they require a copied version you will have to get the copy certified by a Vietnamese Government agency.

Your passport photo will have to follow the standards of passport photos in Vietnam.

1.Do not wear anything in your hair.

2. No glasses or sun glasses,

3. The photo of your face must be from the absolute  front.

4. No smiling

5. Ears have to be visible

6. Wear a white shirt

7. The pictures size must be 3 x 4 cm.

8. The photo is valid for a year.

After you got all of these papers ready, you will send it to the Labour and Social Welfare Service of the province/city where you are working. They will have to inform if they approve your work permit application or any changes needed within 15 days.

Note: Tourist visas work as before and there is no problem to apply or extend 1 month tourist visas.

Vietnam Work Permit Information

Foreign nationals assigned to work in Vietnam are required to show a degree of proprietary knowledge, a special skill or a manager/executive-level skill not readily available in the domestic labor market of the country. You may convert from visitor status to work status while staying in Vietnam or as the work permit application is in process.

However, foreign nationals cannot begin work until the application is approved and considered legal. Foreign nationals who enter Vietnam for employment for a duration of three (3) months or more are required an MEBV (Multiple Entry Business Visa and Work Permit). The Work Permit application has to be sponsored by a company or entity registered and recognized in Vietnam. 20% of managers, executives and specialists of foreign companies with intra-company transferees from outside the country, according to Vietnamese law, should be composed of Vietnamese nationals.

The inclusion of managers and executives is described as:

•    Foreigners who directly control a foreign enterprise located in Vietnam

•    Foreigners subject to general guidance only by shareholders and the board of directors of the enterprise

•    Foreigners who do not participate directly in the provision of services

Specialists are described as foreign nationals with adequate experience in management, business administration, or product development. They should also be highly qualified or experienced in research, equipment management and technical knowledge.

To obtain a Work Permit in Vietnam, applicants should satisfy the following requirements:

•    Be at least 18 years of age

•    Health in good condition to satisfy the specific demands and requirements of the job

•    Free of any criminal record or a national security offence, not currently facing criminal prosecution, or not serving a criminal sentence during assignment.

•    Must be a specialist, manager, or executive.

Some foreign nationals are exempt from getting the Work Permit and can work in Vietnam holding only business visas. These individuals are:

•    Foreigners entering Vietnam to work for less than three (3) months or to resolve emergency cases are exempt. Emergency cases are described as complex technical or technological incidents that affect or threaten to affect business activities and production to the  gravity cannot be managed adequately by Vietnam-based personnel. Foreign employees are required to submit their full name, passport number, nationality, job description and an employment contract copy indicating a period of no more than ninety (90) days to the Labor Department

•    Members of a limited liability company having two or more members

•    Members of the board of directors of a shareholding company

•    Owners of a single-member limited liability company

•    Employees that promote and market services belonging to foreign service suppliers

•    Vietnam’s Ministry of Justice-certified practicing lawyers

Employees of foreign-based contractors and heads of foreign representative and branch offices were recently required the Work Permit. The Work Permit validity period lasts depending on the duration of assignment indicated in the employment contract, but no more than three (3) years. Renewals are also dependent on the employment contract, with a maximum of three (3) years for every renewal. Individuals can renew up to a maximum of three (3) times.

General information:

  • Citizens of Sweden visiting Vietnam for up to 15 days are exempted from Vietnam visas if they meet the following conditions (please click here for the conditions).

  • Visitors who intend to stay in Vietnam for more than 15 days need to apply for visa.

China and its neighbor Vietnam are considering building a visa-free tourism zone on the border of the two countries, tourism authorities said Wednesday.

The visa-free zone will include Dongxing City in southwest China’s Guangxi Zhuang Autonomous Region and Mong Cai City in northern Vietnam, said Yu Xiaojun, deputy chief of the Guangxi’s tourism bureau.

Tourists, and their vehicles, from China and Vietnam will not be required to have a visa or permit to enter the zone, he said.

The two cities have already worked out a blueprint, currently awaiting both countries’ approval, Yu said, without giving a time frame.

Once given the go ahead, the project will take five to ten years to take shape, said Zhu Shengyong, Party chief of Dongxing City.

On Monday, Dongxing City completed the construction of the largest marketplace on the China-Vietnam border, which is located on the east bank of the Peilum River, facing Mong Cai.

The 51-hectare market, costing 2 billion yuan (305 million U.S. dollars), includes border trade wharfs, import and export facilities and various commodity markets.

In 2010, China and the Association of Southeast Asian Nations (ASEAN) established the China-ASEAN Free Trade Area, which eliminates tariffs on 90 percent of products traded between China and ASEAN member countries.

Travellers to south-east Asia could get single visa

A group of nine south-east Asian countries may soon be offering a unified visa, similar to the one currently available in Europe.

Adventurous tourists think of booking flights to Thailand may be excited to learn that they could soon get a single visa allowing access to several other south-east Asian nations as well.

Singapore, Cambodia, Vietnam and Indonesia are among the countries joining Thailand in considering the new system, AFP reports.

As a result, travellers would be easily be able to string together a tour including surfing in Bali, exploring the historic temple of Angkor Wat in Cambodia and shopping in Bangkok.

ASEAN countries welcomed more than 65 million foreign visitors in 2009, and other member nations include the Philippines, Laos, Myanmar and Brunei.

In its recent five-year strategic plan, the organisation acknowledged the difficulty of travelling around south-east Asia.

“One of the major concerns of visitors is the difficulty of obtaining visas, a series of widely differing regulations and information needs for visas,” the report said.
