Vietnam Immigration Policy for Processing Vietnam Visa

Foreigners, who stay in Vietnam more than 1 year and want to ask for a temporary residence card, are suggested to send the temporary residence card to the Vietnam Immigration Office or Police Immigration Management of Cities/Provinces under Central authority.

  • Procedures provided for asking to issue Vietnam visa, extending, supplementing, visa modifying and asking for temporary residence  certificate:

Foreigners would like to ask to issue, extend, supplement, modify visa and temporary residence certificate do need submit records to the Vietnam Immigration Office or Police Immigration Management of Cities/Provinces under Central authority.

  • If asking to issue visa, extending, supplementing, modifying visa, asking for temporary residence certificate are for tourism, the Vietnam international tourism companies -behalf of customers – will be responsible for dealing with Vietnam Immigration Office or Police Immigration Management of Cities/Provinces under Central authority.
  • If extending, supplementing, modifying visa, asking for temporary residence certificate are for the individuals such as: family visit, marriage, child adoption, treatment … the application must be confirmed by the ward, commune or shelter agencies which has jurisdiction.
  • Procedure provided for asking to issue visa in case of losing passport:

In case your passport is lost in Vietnam, you do need immediately report to the ward, commune where your passport was lost or contact the diplomatic representatives, your Embassy or Consulate in Vietnam to ask for a new passport or other documents that can be used as a valid passport. And then, you should apply for the new Viet nam visa.

  • Procedures provided for staying purpose conversion:

Foreigners who want to convert their purpose of staying in Vietnam must be approved by agencies, organizations or individuals as a guarantee to complete all the procedures in Vietnam Immigration Office or Police Immigration Management of Cities/Provinces under Central authority (where the agencies, organizations or individuals guarantee).

In order to create favorable conditions for foreigners to Vietnam, the Prime Minister has agreed to abolish the immigration declaration for all passengers when they do procedures of entry and exit at Vietnam’s international airports since September 15, 2010.

The Immigration Department, Ministry of Public Security has officially announced that: from September 15, 2010, all passengers don’t have to fulfill the immigration declaration form when they do procedures of entry and exit at the border gates which have been equipped with reading-passport machines and networked computers. At the rest border gates will clear the immigration declaration when meet the above conditions. Ministry of Public Security has issued new immigration declaration form in order to apply at the border gates which are managed by the Ministry of National Defense but have not been equipped with reading-passport machines, networked computers.

The Prime Minister has also assigned the Ministry of National Defense to preside and coordinate with the Ministry of Finance, Ministry of Public Security to urgently equip reading-passport machines, networked computers and so on for the border gates which are managed by the Ministry of National Defense. In addition, Ministry of Finance has issued its own declaration form according to the management requests when the immigration declaration is cleared at the border gates.

Vietnam visa exemption:

Vietnamese people that hold foreign passports and foreigners who are their husbands, wives and children are exempt from visa requirements to enter Vietnam and are allowed to stay for not more than 90 days. In order to be granted visa exemption certificates at Vietnamese representative offices abroad, overseas Vietnamese need conditions:

Foreign-issued permanent residence certificate (PRC) with the validity of at least six months since the date of entrance.

Visa exemption paper (VEP) is granted by Vietnamese appropriate authorities.

Those who expect to stay more than 90 days must apply for visa according to current stipulations before their entrance.

Bilateral visa exemption agreement

Citizens of Thailand, Malaysia, Singapore, Indonesia and Laos holding valid ordinary passports are exempt from visa requirements and are allowed to stay for not more than 30 days; Philippines is allowed to stay for not more than 21 days.

Citizens of China, Bulgaria, Kyrgyzstan, North Korea, and Rumania holding valid ordinary passports for official mission and citizens of 52 countries holding valid diplomatic or official passports are exempt from visa requirements. Unilateral visa exemption

Visa with 30-day validity is exempted for officials from ASEAN secretariat holding many different kinds of passports.

Citizens of Sweden, Norway, Denmark, Finland, Japan and South Korea holding different kinds of passports are exempt from visa requirements and are allowed to stay for not more than 15 days.

Others who want to enter Vietnam must be provided with a visa.

Tourist visa is valid in 30 days.

Visa is issued at the Vietnamese diplomatic offices or consulates in foreign countries. Visa is possibly issued at the border gates to those who have written invitations by a Vietnamese competent agencies or tourists in the tours organized by Vietnamese international travel companies.

Application files for visa: the entrance application (printed form); two 4×6 cm photos; passport and fee for the visa issuance.

Visa extension: Served by all international travel companies.

Foreigners having blood or marriage ties with Vietnamese citizens exemptible from visa

VGP – Foreigners who are spouse and children of a Vietnamese citizen or overseas Vietnamese can acquire visa exemption certificate if they prove their marriage or blood relations with the Vietnamese national.

Question: What kinds of papers do foreign-passport holders who are spouse/children of a Vietnamese citizen or overseas Vietnamese have to present to acquire the certificate of visa exemption? What are the competent bodies? And how long to obtain the certificate?

Answer:

  1. Foreigners who are spouse or children of a Vietnamese citizen or overseas Vietnamese are exempted from Vietnamese visa. To acquire the certificate of visa exemption, they have to prepare the following papers:
    • One (01) application form for visa exemption;
    • Two (02) recent color passport photos with white background, in the straight-looking stature, without color glasses, and wearing nothing on the head (01 photo stuck to the application form, the other left separately);
    • Foreign passport with at least six-moth validity since their entry into Việt Nam (together with a copy of the passport for the archives);
    • One of the following papers to prove their marriage and family relations with the Vietnamese national (together with a copy for the archives):
      • Marriage certificate;
      • Birth certificate;
      • Paper confirming the parents-children relationship;
      • Other valid papers under Vietnamese laws.
  2. The Vietnamese competent bodies to give the certificate of visa exemption include: – Diplomatic representative agencies in other countries; – Việt Nam Immigration Department, administered by the Ministry of Public Security.
  3. The certificate of visa exemption must be issued within seven working days since the reception of all valid papers.
